1. Scope of Application:


These General Business Terms of

HCx Consulting GmbH,

(hereafter: HCx Consulting GmbH)


apply for the carrying-out of open events such as e.g. Trainings, seminars, exercises, workshops. These General Business Terms apply to all offers and services of HCx Consulting GmbH and apply exclusively. General business terms of the participant are not a component of the contract, their incorporation is hereby expressly objected to.

2. Scope of Performance:


Insofar as nothing else has been offered and agreed, HCx Consulting GmbH will provide the participant of the training with the following in the medical centre of excellence in Wendisch Rietz: conference and function rooms with suitable equipment, lecturers and premises for breaks. The service is extensively described in the respective brochure (seminar programme) and/or in the seminar programme on the website of HCx Consulting GmbH and is to be paid for at the named rate (participation fee), insofar as nothing else has been agreed.

3. Enrolment and Online Ordering Process:


Your enrolment – even online – on the filled form, by email or fax represents a binding offer for conclusion of a contract for services with HCx Consulting GmbH. If the participation fee is not settled by the participant himself, but by his employer, then in addition to the enrolment of the participant, the absorption of cost by the employer must be confirmed. The contract for services does not come into being, however, until the receiving of our written confirmation or with the receiving of the invoice as the acceptance of your offer for the conclusion of a contract for services. A change to the booking or a cancellation can only take place in the framework of the cancellation warranty described in point 5. All enrolments are booked in the order in which they are received.

The online ordering process takes place in the steps described in the following:

The participant gets to the individual events via the overview sites for the individual event offers. Detailed information on and descriptions of the event can be called in the individual view. The individual view also contains information on the price and availability of the event.

Payment is principally on account by transfer to one of the accounts of HCx Consulting GmbH named in it. In exceptional cases, it is also possible to pay the participation fees in cash. HCx Consulting GmbH does not make any charges whatsoever for either of these types of payment.

The participant has the possibility of booking the respective event via the enrolment form. The view appearing there once again shows the customer detailed price information and indicates whether places are currently still available for the selected event or not.

The customer can “Start the order process” with a further click on the appropriate button. After this selection, the customer once again has the opportunity to check all the input information and if necessary to correct them with the button “Change".

After the confirmation of the input information, these general business terms and the data privacy conditions of HCx Consulting GmbH are made accessible to the customer and supplied to him for downloading for the purpose of saving them on a durable data medium.

By clicking on the button “Book with liability to pay the charge” the participant makes a binding declaration of wanting to book the selected event. In the case of orders made online, HCx Consulting GmbH will confirm receipt of the booking immediately. The automatic confirmation of receipt still does not yet represent a binding acceptance of the booking. Together with the confirmation of receipt, the participant will be sent these general business terms and the event information once again.

4. Payment Terms:


The participation frees shown in the invoice incl. VAT are per participant. The participant is to pay the remuneration regardless of the services of third parties by the deadline named in the invoice at the latest, normally by five weeks before the booked event date. The participant defaults without a reminder.


5. Substitution, change and cancellation:


Substitution: You can appoint a substitute instead of the enrolled participant at any time. You will not incur any additional costs for this.

Change: You can at any time change the booking to a different event date or even a different event. Please inform us of this in writing. In the case of a booking change (only possible once) we make the following booking change charges (the date of receipt is decisive). Consumers’ cancellation rights remain hereby unaffected (see the cancellation policy at the end of these general business terms)

  • Booking change up to 4 weeks before start of event: no charge
  • Booking change up to 3 weeks before start of event: 10 % of the participation fee, but at least 30.00 € plus VAT*
  • Booking change from 2 weeks before start of event: 20 % of the participation fee plus VAT*
  • *In the case of subsequent cancellation, the remaining costs accrue in the amount of 40 or 80 % of the participation fee plus VAT. The date of receipt of the booking change is decisive.

Cancellation: You can withdraw from the contract at any time. This is, however, only possible in writing. Please note that we charge the following cancellation fees (the date of receipt is decisive). Consumers’ cancellation rights remain hereby unaffected (see the cancellation policy at the end of these general business terms)

  • Cancellation up to 4 weeks before start of event: no charge
  • Cancellation up to 3 weeks before start of event: 50 % of the participation fee plus VAT*
  • Cancellation from 2 weeks before start of event: 100% of the participation fee plus VAT*. This also applies in the event of the non-appearance of the enrolled participant.


The above-named booking change and cancellation fees do not apply if and insofar as the participant proves that no or only a slight loss has occurred for HCx Consulting GmbH due to the booking change/cancellation.


6. Cancellation of Seminars:


We reserve the right to cancel the event due to insufficient demand and/or number of participants (by 7 days before the planned event date at the latest) or for other important reasons for which we are not responsible (e.g. sudden illness of the speaker, force majeure). Participation fees that you have already paid will of course be paid back to you. Other liability and compensation claims that do not relate to injury to life, limb or health are ruled out insofar as there is no intent or gross negligence on our part. Please also note this for hotel rooms, air or rail tickets you have booked.

7. Subject to Alterations:


We are entitled to carry out necessary changes to content, methods and organisation (e.g. due to changes in the law) before or during the event, insofar as these do not substantially change the benefit of the announced event for the participant. If necessary (e.g. illness, accident), We are entitled to replace the intended speakers, in the event that this becomes necessary (e.g. illness, accident), with other persons who are equally qualified as regards the announced subject. The documents provided in the context of the training are produced to the best of knowledge. Liability for the correctness, up-to-dateness, completeness or quality of the contents is ruled out.


8. Liability:


No liability whatsoever is accepted for force majeure. This applies to all claims not regulated in these conditions. We are, however, liable without restriction for intent and gross negligence. Liability for ordinary negligence is limited to the infringement of essential contractual duties adherence to which the participant can normally rely upon and which are of central importance for contracts of this kind, and to the typically foreseeable extent of loss.

9. Data Privacy:


By enrolling the participant declares that he consents to the storage of personal data for the purposes of seminar organisation.


10. Copyright:


HCx Consulting GmbH and/or the speakers of the respective event reserve all rights to the seminar documents. It is forbidden to reproduce or pass on to third parties any seminar documents without express written agreement.


11. Photographs and Film Recordings:


Photographs and film recordings in the medical centre of excellence in Wendisch Rietz are generally forbidden and only possible after consultation with and approval from the course management and permitted with agreement of the persons shown.


12. Separability Clause:


If individual conditions of these general business terms are ineffective or incomplete, then they are replaced by the legal conditions. The ineffectiveness of individual stipulations does not prejudice the validity of the remaining provisions.


13. Further Consumer Information:


The contractual language is German.

Contracts that have been concluded online will be stored by HCx Consulting GmbH after the conclusion of the contract and will make them available to the participant upon request.


Cancellation Policy


This cancellation policy applies only to consumers: a consumer is someone who concludes transactions that cannot be primarily attributed to his commercial or independent occupational activity.

Right of Cancellation


You have the right to cancel this contract within fourteen days without the obligation to give reasons. The cancellation time limit is fourteen days from the day of the concluding of the contract.

To exercise your right of cancellation you must inform us ( HCx Consulting GmbH, Ulmenstraße 12, 15864 Wendisch Rietz, Tel.: 03679- 429810, Fax: 03679- 429809, email:, by means of a clear declaration (e.g. a letter sent by mail, fax or email), about your decision to cancel this contract. For this, you can use the template cancellation form , although this is not compulsory.

To adhere to this cancellation time limit, it is sufficient for you to send off the message about the exercising of your right of cancellation before the elapsing of the cancellation time limit.


Consequences of Cancellation


If you cancel this contract, we are to pay back to you all payments that we have received from you, including the delivery costs (with the exception of additional costs that arise from you having chosen a different type of delivery than the cheapest standard delivery that we offer), without delay and within fourteen days, at the latest, from the day upon which we received the message about your cancellation of this contract. For this reimbursement, we will use the same means of payment that you have used in the original transaction, unless something different has been expressly agreed with you; under no circumstances will you be charged for this reimbursement.

If you have demanded that the services begin during the cancellation time limit, you are to pay to us an appropriate amount corresponding to the share of the services already rendered by us up to the point in time at which you informed us of the exercising of the right of cancellation in relation to the full scope of the services envisaged in the contract.
